  1. Arkansas, Oklahoma
    The U.S. Army Corps of Engineers (Corps), Little Rock and Tulsa Districts, are revisiting a 2005 study to evaluate the McClellan-Kerr Arkansas River Navigation System (MKARNS) for enhanced commercial navigation opportunities. The study area includes the entire MKARNS in Arkansas and Oklahoma including approximately 445 miles of river from the Mississippi River to the Port of Catoosa near Tulsa, OK. A series of 18 locks and dams,13 in Arkansas and 5 in Oklahoma, provide for commercial navigation throughout the length of the MKARNS.
  2. Oregon, Washington
    The Federal Highway Administration's Interstate Bridge Replacement Program intends to replace the I-5 interstate bridge between Oregon and Washington where it crosses the Columbia River. The purpose of the undertaking is to improve I-5 corridor mobility by addressing present and future travel demand and mobility needs.
  3. Mississippi
    The U.S. Army Corps of Engineers (Corps), Vicksburg District, proposes to develop a Programmatic Agreement, in accordance with 36 CFR § 800.14(b)(3), for the proposed Pearl River Basin, Mississippi Federal Flood Risk Management Project, (Project). The Project will include a variety of flood control activities, which require further design and private landowner approval for specific measures.

  5. North Carolina
    The NCDOT is proposing the Kinston Bypass, a projected four-lane, median-divided freeway with full control of access in Lenoir, Jones, and Craven counties in North Carolina. The project extends from US 70 near La Grange (in Lenoir County) to US 70 near Dover (at the Jones and Craven county line). The project study area is located mostly in Lenoir County in eastern North Carolina, with the eastern part of the project study area in Craven and Jones counties. The proposed project is approximately 21 miles long and includes upgrades of existing US-70 and construction of a portion on new location.
  6. Iowa

    The US Environmental Protection Agency (EPA) Region 7 proposes to develop a Programmatic Agreement to exclude certain activities funded by both the Clean Water (CW) and Drinking Water (DW) State Revolving Funds (SRF) and administered by the SRF Agency in Iowa, the Iowa Department of Natural Resources (IDNR), from review on a case-by-case basis with the Iowa State Historic Preservation Office (SHPO). The EPA has already delegated Section 106 responsibilities, including resolution of adverse effects to SRF agencies for activities funded by the CWSRF pursuant to the 1990 Nationwide PA.

  7. Alabama
    Fort Rucker proposes to develop a Programmatic Agreement for Section 106 compliance in accordance with 36 CFR § 800.14(b)(2) in order to take into account effects to historic properties within the installation’s boundaries. Note that during the development of this PA, the name of the installation changed from Fort Novosel to back to Fort Rucker, so some correspondence reflects the previous name.
  8. Montana
    The Farm Service Agency (FSA) is proposing to develop a Programmatic Agreement, in accordance with 36 CFR § 800.14(b)(3), to establish a streamlined process for Section 106 review in Montana. The PA will cover routine actions that have little to no potential to affect historic properties. Due to the natural disasters in Montana in 2021, FSA consulted with the Montana State Historic Preservation Office (SHPO) on over 600 individual projects. The large number of FSA reviews caused long delays in SHPO’s ability to respond resulting in complaints from producers to the Governor’s office.
  9. California
    Military Ocean Terminal Concord (MOTCO) proposes to substantially expand its storage area for munitions and explosives. As a result of the modernization, it may be necessary to update, reconfigure, realign, and/or remove an unknown number of existing railroad lines that access the Rail Barricaded Sidings (RBS). Of the 38 RBS at the installation, MOTCO is proposing to remove up to seven, abandon-in-place or possibly demolish an additional 24, and retain seven.
  10. California

    The Environmental Protection Agency (EPA), Region 9, proposes to develop a Programmatic Agreement for Section 106 compliance in accordance with 36 CFR § 800.14(b)(2) in order to take into account effects to historic properties regarding the Drinking Water State Revolving Fund (SRF) Program for the State of California, with the following objectives: 1) designate the State Water Board as the lead agency for complying with Section 106; 2) establish a review process specific to the California SRF program; and 3) authorize the State Water Board to make findings of "no historic properties affecte
