The Farm Service Agency (FSA) is proposing to develop a Programmatic Agreement, in accordance with 36 CFR § 800.14(b)(3), to establish a streamlined process for Section 106 review in Montana. The PA will cover routine actions that have little to no potential to affect historic properties. Due to the natural disasters in Montana in 2021, FSA consulted with the Montana State Historic Preservation Office (SHPO) on over 600 individual projects. The large number of FSA reviews caused long delays in SHPO’s ability to respond resulting in complaints from producers to the Governor’s office. Most of these undertakings were similar in size and scope and had minimal ground disturbance. This PA seeks to identify those re-occurring projects with minimal impacts to resources and establish a programmatic approach to their review.
