Section 106 Resources for Indian Tribes

Online On-demand Training

• Section 106 Training for Indian Tribes is a step-by-step introduction to the Section 106 process for Tribal Leaders and Tribal staff in Tribal historic preservation and natural and cultural resources and includes suggestions for navigating consultation with federal agencies and maximizing opportunities for influencing federal decision making. 
   
• Native Hawaiian Organizations in the Section 106 Process is designed to assist Native Hawaiian Community members and leaders advance their understanding of the Section 106 review process and increase awareness of strategies for engaging in consultation with federal agencies.
   
• Early Coordination With Indian Tribes for Infrastructure Projects is a 90-minute online course for applicants for federal permits, licensing, or funding and federal permitting agencies and staff. Course Flyer
   
• Native American Sacred Sites and the Federal Government is offered by the Departments of Defense, the Interior, Agriculture, and Energy and the ACHP to help non-Tribal people better understand and appreciate Indian sacred sites.

Guidance for Indian Tribes, Native Hawaiian Organizations, and Federal Agencies

This guidance is intended to assist Indian Tribe and Native Hawaiian Organization (NHO) officials in participating more effectively in the Section 106 review process. Understanding federal agency responsibilities and the rights of Indian Tribes and NHOs is of central importance in ensuring that you have the opportunity to voice your views. See the Section 106 review process for more information.

While Tribal and NHO participants may have varied issues and concerns regarding the Section 106 process, the following guidance documents address the most common issues brought to the attention of ACHP staff.

Consultation with Indian Tribes

• Section 101(d)(5) Guidance for Indian Tribes is intended to assist Indian Tribes in their decision-making processes regarding whether and how to enter into Section 101(d)(5) agreements with the ACHP and to provide insight into the ACHP’s interpretation of Section 101(d)(5).

• Early Coordination with Indian Tribes During Pre-Application Processes: A Handbook This handbook presents recommendations for federal agencies, applicants, and Indian Tribes to work together in pre-application information gathering or prior to initiating the Section 106 process. • Types of Agreement Documents in Section 106: What They Are and When They Should Be Used clarifies the different types of agreements mentioned in the ACHP’s regulations at 36 CFR Part 800 and when it is appropriate to use them.

• Guide to Working with Non-Federally Recognized Tribes in the Section 106 Process provides information on how non-federally recognized Tribes might participate in the Section 106 process and clarifies how their participation differs from the legal rights federally recognized Indian Tribes and NHOs have to consult with federal agencies in the Section 106 process.
