The United States Army Corps of Engineers, Seattle District (USACE) is proposing the development of a Programmatic Agreement regarding the implementation of the Levee Rehabilitation and Inspection Program under Public Law 84-99 (PL 84-99 Program). This program is a partnership between the USACE and 75 levee sponsors to maintain and rehabilitate 202 eligible systems in Washington, Idaho, and Montana. This PA would cover only levees in the State of Washington. The goal of the PA is to streamline the Section 106 process where feasible, to determine what repairs have no potential effects on historic properties, and what repair activities would result in a finding of no historic properties affected, and what repair activities would require consultation. Levee sponsors are responsible for providing ongoing/routine levee maintenance to a standard acceptable to the USACE. Some types of routine repair actions that fall within the PL 84-99 Program include: riprap armoring placement, culvert replacement, installation of toe drains, replacement of a launchable toes, replacement of displaced levee fill, and mitigation plantings.
