In 1987, the Federal Highway Administration (FHWA), the Hawaii State Historic Preservation Officer, and the Advisory Council on Historic Preservation executed a Memorandum of Agreement (MOA) for the Interstate H-3 Project. The project has been constructed but FHWA and Hawaii Department of Transportation have not yet completed all commitments in the MOA, with 4 items from the MOA pending completion or submittal of reports to consulting parties about their completion. In accordance with Stipulation K, the FHWA proposes to add three additional commitments to capture commitments that were in a National Environmental Policy Act document related to culturally sensitive areas. One includes letting a construction contract for removal of an asphalt "temporary" access road under a portion of H-3 put in at the time of roadway construction. They also propose to relocate amenities installed for NHO stewards. FHWA to provide more information on the scope of each activity. ACHP to determine whether these activities should be included within the MOA or should be considered a separate undertaking. FHWA proposes to conduct quarterly meetings (every 3 months) to discuss the amendment and implementation of remaining commitments from this MOA. The signatories and invited signatories who participate in these meetings include the ACHP, Hawaii SHPD, Hawaii DOT, FHWA Hawaii Division, and Office of Hawaii Affairs as well as several Native Hawaiians/NHO representatives.
