Consultation Assistance

The ACHP officially participates in various GSA consultations and also provides GSA with technical assistance when appropriate. Guidance Issuance

To address Section 106 responsibilities associated with the disposal of real property, and with input from an inter-agency workgroup, ACHP developed and issued Guidance on Use of Real Property Restrictions or Conditions in the Section 106 Process to Avoid Adverse Effects. Sometimes referred to as covenants or easements, preservation conditions are restrictions and conditions on transfers of federal real property, put in place prior to transfer and written in such a way that they are adequate and legally enforceable to ensure the long-term preservation of a historic property's historic significance.

Regional Programmatic Agreements

To address Section 106 responsibilities associated with operations and maintenance of GSA's real property as well as some leased property, in accordance with Federal Agency Program Alternatives, many of GSA's regions utilize regional programmatic agreements.  These agreements, executed by the ACHP and various SHPOs, are in place for Region 4 (AL, FL, GA, KY, MI, NC, SC, and TN); Region 8 (CO, MT, ND, SD, UT, WY); Region 9 (AZ, CA, HI, NV, Guam, CNMI); and Region 11 (D.C.).  Section 106 agreements GSA filed with the ACHP are available by request; please contact ACHP's Office of Federal Agency Programs to contact ACHP's GSA Liaison (202-517-0200).

Program Comment Issuance

In accordance with the Federal Agency Program Alternatives (36 CFR § 800.14(e)) ACHP issued and extended GSA's Program Comment on Select Envelope and Infrastructure Repairs and Upgrades to Historic Public Buildings, which corresponds to respective Technical Guidelines developed by GSA. The Program Comment was established to promote best preservation practices within GSA for ARRA-funded projects, as well as limited scope projects with other funding sources.
