This course is designed to enhance federal agencies' understanding of Section 304 of the National Historic Preservation Act. Section 304 protects certain sensitive information about historic properties from disclosure to the public when such disclosure could result in a significant invasion of privacy, damage to the historic property, or impede the use of a traditional religious site by practitioners. The course assists federal agency officials and staff with identifying the types of information that may be protected from release by Section 304, as well as how Section 304 may apply to different consultation scenarios. Federal agencies will be able to address issues that may arise during Section 106 review regarding the scope and limits of Section 304 with Indian tribes, Native Hawaiian organizations, and other parties concerned about the confidentiality of sensitive information.
