    Based on interviews with officials from 57 tribes and 21 federal agencies, as well as comments submitted by 100 tribes in 2016 on tribal consultation for infrastructure projects, GAO identified key factors that tribes and agencies believe hinder effective consultation on infrastructure projects. Federal agencies are required, at times, to consult with tribes on infrastructure projects like pipelines that may harm tribal natural and cultural resources.

    The Advisory Council on Historic Preservation has approved an exemption that relieves the General Services Administration from historic preservation review requirements under the National Historic Preservation Act for specified routine operations and maintenance. The exemption was approved on January 13, 2023, and was published in the Federal Register on January 23, 2023.

The examples in this section will assist federal agencies in engaging the public in carrying out mitigation measures and provide examples for a range of approaches that may further public education and awareness building, the creation of educational materials for specific audiences, and heritage tourism efforts. These kinds of stipulations also present opportunities to involve students and youth in learning about or working with historic properties.

    Federal agencies have sought the opinion of the Advisory Council on Historic Preservation (ACHP) regarding whether federal law authorizes them to use appropriated funds to assist State Historic Preservation Officers (SHPOs) in connection with reviews under Section 106 of the National Historic Preservation Act (NHPA), 16 U.S.C. § 470f. The ACHP believes that this expenditure of federal funds to SHPOs is authorized by Section 110(g) of the National Historic Preservation Act (NHPA).
