First Amendment to Programmatic Agreement Among the Lexington Veterans Affairs Medical Center - Leestown Division Station 596, the Kentucky State Historic Preservation Officer, and the Advisory Council on Historic Preservation Regarding Routine Management Activities at the Lexington Veterans Affairs Medical Center - Leestown Division, Fayette County, Kentucky

This program comment provides the Federal Communications Commission (FCC) with an alternative way to comply with its responsibilities under Section 106 of the National Historic Preservation Act, 54 U.S.C. 306108, and its implementing regulations, 36 CFR part 800 (Section 106), with regard to the effects of wayside poles and associated infrastructure installed by the nation's freight and passenger railroads to deploy Positive Train Control (PTC) systems on historic properties.

The United States Army is currently undergoing a significant privatization effort of lodging facilities throughout the continental United States.  This privatization effort has already occurred at 21 installations in two previous phases.  The third phase consists of 21 additional installations in 13 states and is the subject of a new prototype Programmatic Agreement (PA).

Overview The regulations implementing Section 106 of the National Historic Preservation Act specify that when commenting on an undertaking affecting a National Historic Landmark, the ACHP may request a report from the Secretary of the Interior under Section 213 of the Act to assist it in the consultation. The preparation of these reports, like other functions assigned to the Secretary under the Act, is carried out by the National Park Service (NPS) on the Secretary’s behalf.
