Nationwide: Development of an Exemption to Section 106 for the Interstate Highway System

As reported in the summer 2004 and winter 2005 Case Digests, the Federal Government was challenged by the potential historic significance of the entire Interstate Highway System as its 50th anniversary approaches.

The ACHP worked with the Federal Highway Administration (FHWA) and other groups to develop an administrative exemption that streamlines the review of FHWA’s projects that may affect the interstate system.

After publishing in the Federal Register the proposed exemption for the Interstate Highway System, the ACHP received comments from 33 individuals and organizations, mostly supportive of the proposed exemption.

In February 2005, the ACHP members approved the final Interstate Highway exemption. In response to the ACHP’s action, FHWA withdrew a proposal for a legislative exemption for Section 106. For background information on this case, see the summer 2004 and winter 2005 Case Digests.
